Abstract

Eagle County's Land Use and Zoning Code establishes comprehensive regulations for zoning districts, land use, lots, buildings, structures, and signs. ​ The code aims to create zoning districts within the county, detailing permitted, limited, special, and prohibited uses in each district. ​ It includes standards for temporary and seasonal uses, accessory dwelling units (ADUs), and various types of signs. ​ The code also outlines requirements for residential and nonresidential development, including setbacks, building heights, and parking. Specific provisions address temporary commercial sales, model homes, construction uses, and recreational vehicles. ​ The code ensures orderly, compatible, and safe use of property while protecting public health, safety, and welfare. ​

Hello!

We are writing to express our concerns regarding the proposed Estate Residential (RE) zoning and its alignment with the Mid-valley Community Plan (Missouri Heights Character Area).


We have compiled a document explaining the proposed Estate Residential zoning (as defined in Module 1) and compared its parameters to Chapter 4 of the Mid-valley Community Plan.

Our review has revealed that the RE zone, as currently defined, does not align or comply with this plan.


We understand that the purpose of the code is to implement this plan, as stated in 1.1.1.3, "Implement the Eagle County Comprehensive Plan and special area plans incorporated therein."

Additionally, without the Standards being defined in 2.1.4, any review comments will be based on partial information and may be modified when further information is available.


We are sharing these comments early, outside of the TAC/Public review, as we believe they apply at the "uber" level and can add value to the process.


We recommend that the draft land use code include similar compilations of zoning parameters to increase understanding, centralize information, and make it more understandable.
